Under North Carolina law each municipality that enforces zoning regulations is required to have a Zoning Board of Adjustment (ZBA). The powers and duties of the ZBA, like the ABC Commission, are outlined in state statutes. This ZBA is established to hear appeals from the decisions of the Zoning Administrator in the enforcement of the Zoning Ordinance; to hear requests for variances from the provisions of the Zoning Ordinance; and to hear and decide upon requests for Conditional Use Permits. Membership on this board takes a special commitment because the ZBA conducts their hearing in accordance with judicial rules of procedure and decisions can be publicly unpopular as rulings of the Board must be made based upon strict interpretation of applicable laws and not upon public opinion or desire. There are five members and three alternate members of the ZBA.
